The petitioner seeks bail in a case under Sections 420, 467, 468 of the Indian Penal Code and Sections 25(1B)a, 26 of the Arms Act and Section 17 of the CLA Act. The police got information that some extremists were to assemble at a particular place. On such, the police raided the place and apprehended the petitioner. From the possession of the petitioner, one loaded country made pistol and fake identity cards were recovered. It is submitted that the seizure list witnesses are of different places and they do not belong to the place where the raid was conducted. Two criminal cases are pending against the petitioner but one of those cases is of the year 2005. The petitioner is in jail since 16.03.2015.

Considering the facts aforesaid and the fact that the

Patna High Court Cr.Misc. No.24656 of 2015 (3) dt.12-08-2015 2/2 petitioner has already remained in jail for about five months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P.S. Case No. 138 of 2015.
