2. The petitioners seek bail in connection with Patrakar Nagar P.S. Case No.765 of 2023 instituted for the offence punishable under Sections 419, 420, 467, 468, 471 and
Patna High Court CR. MISC. No.8568 of 2024(4) dt.01-03-2024 2/3 120(B) of the Indian Penal Code.
3. As per F.I.R. the allegation against the petitioners is that they are involved in setting of different competitive examination by using unfair and illegal means.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioners which could correlate them to this case. Nobody has complained against the petitioners in respect of cheating. Petitioners have got no criminal antecedent and they are languishing in judicial custody since 03.10.2023.
5. Learned APP for the State has vehemently opposed the prayer for bail.

From perusal of the F.I.R., case diary, seizure list as well as impugned order of the learned Additional Sessions Judge-XXVI, Patna dated 08.01.2024, it appears that F.I.R. registered against eight named accused persons including the petitioners and other unknown persons on the basis of written report of Police Sub-Inspector Alok Kumar. Both the petitioners arrested in the coaching premises of SRM IT Solution and several materials seized from the locker of said SRM IT
Patna High Court CR. MISC. No.8568 of 2024(4) dt.01-03-2024 3/3 Solution. It is submitted that petitioners have got no concern with the alleged recovery and SRM IT Solution Coaching Centre rather the same belongs to co-accused Manish Kumar who happens to be Director of the said Centre. The main accused in this case are Pushpak Kumar, Manish Kumar, Rajan Kumar Mishra and others. Petitioners are in custody since 03.10.2023, accordingly the prayer for bail of the petitioner is allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Patrakar Nagar P.S. Case No. 765 of 2023.
