Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

It is alleged that petitioner took huge amount from the informant and others in the name of providing job in Railway but he refused to return the amount.

The contention on behalf of the petitioner is that the informant had taken loan from the petitioner and when petitioner demanded the dues amount, the informant lodged this false case. It is further submitted that earlier petitioner was granted privilege

No.16241 of 2016 (2) dt.22-04-2016 2/2 of anticipatory bail by a co-ordinate Bench of this Court but he could not deposit the amount in question, as a result of which he could not avail the privilege of anticipatory bail. Learned counsel appearing for the informant submitted that petitioner was granted privilege of anticipatory bail on the term of deposit of the amount and, similarly, informant was also directed to deposit the amount which is claimed by the petitioner and, thereafter, the informant deposited the amount but petitioner did not comply with the order of this Court.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Patna in connection with Rajiv Nagar P.S.case No. 114 of 2012.
