The petitioner seeks bail in a case registered under Sections 302/34/120B of the Indian Penal Code. The prosecution case in brief is that on the information of Santosh Yadav, when the informant went to the place of occurrence, he saw that the accused persons were cutting neck of his father with axe.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-09-2018. Charge sheet has already been submitted. There is no allegation of assault alleged against the petitioner. The main allegation is against co-accused

Patna High Court CR. MISC. No.5327 of 2019(3) dt.23-04-2019 2/2 Sonelal Manjhi who is alleged to have assaulted the deceased which led to his death. The petitioner is said to be member of unlawful assembly.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Mahkar P.S. Case No. 135 of 2018.
