JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 201 of the Indian Penal Code.
The present case was lodged against unknown but in course of investigation, the wife and the mother of the deceased expressed their suspicion against the petitioner. Learned counsel for the petitioner points out that the petitioner was granted privilege of anticipatory bail by this court vide order dated 23-07-2013 passed in Cr. Misc. No. 11202 of 2013 with direction to surrender before the court below within four weeks but the petitioner was arrested in Muffasil P.S. Case No. 708 of 2013 and faced trial before the Sessions Court in Sessions Trial No. 650 of 2013 and was acquitted of the
Patna High Court Cr.Misc. No.14784 of 2016 (2) dt.11-04-2016 2/2 charges and, that was the reason, he could not surrender as he was languishing in jail custody since 07-08-2013 in the aforesaid Sessions Trial No. 650 of 2013.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sasaram (Model) P.S. Case No. 183 of 2012 corresponding to Sessions Trial No. 261 of 2014 to the satisfaction of Learned Additional Sessions Judge-II, Rohtas at Sasaram. (Hemant Kumar Srivastava, J) A.K.V./- U T
