JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Sonbarsa Raj (Kash Nagar O.P.) Case No. 160 of 2017 disclosing offences under Sections 363, 366A/34 of IPC and Section 8 of the POSCO Act.

As per F.I.R. petitioner and other accused persons are said to have kidnapped the minor daughter of the informant. Submission of the learned counsel for the petitioner is that the statement of the victim girl under Section 164 Cr.P.C. has been recorded, in which, she has disclosed her age as 20 years and has specifically stated that petitioner has not kidnapped her.

Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.4099 of 2020(2) dt.22-01-2020 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Saharsa, in connection with Sonbarsa Raj (Kash Nagar O.P.) Case No. 160 of 2017.
