The petitioner is languishing in custody since 06.12.2014 in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

The accusation is of robbing in the petroleum dealership of the informant. The name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner that the petitioner has not been put on TIP, statement to that effect has been made in para 7 of the petition. Though, it appears that the petitioner was identified through CCTV footage.

Patna High Court Cr.Misc. No.15536 of 2015 (02) dt.19-05-2015 2/2 Statement has been made in para 16 of the petition that there is no recovery from the petitioner.

Considering the fact that investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Industrial Area P.S. Case No. 31 of 2014. Since the petitioner has criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
