JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One pick-up van laden with Mahua Flower was seized by the police officials and the case was lodged for the offences punishable under Section 414 /34 of the Indian Penal Code and various Sections of the Mahua Flower Act.

Submission on behalf of the petitioner is that petitioner happens to be owner of pick-up van and there is nothing on the entire record to show that the seized pick-up van was stolen property and so far as Mahua Flower is concerned, the co-accused Neeraj Yadav, who was driving the pick-up van at the relevant time, has already been granted privilege of bail by a co-ordinate Bench of this Court.

Patna High Court Cr.Misc. No.15884 of 2016 (2) dt.20-04-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Jamhore P.S.Case No. 80 of 2015.
