Mr.Umanath Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 The petitioner apprehends his arrest in connection with Complaint P.S.Case No. 109 of 2018 registered under Section 498A/34 of the Indian penal Code.

Allegation against the petitioner is of demanding dowry and ousting the informant with respect to demand of dowry. Submission of learned counsel for the petitioner is that as a matter of fact O.P.No. 2 is not ready to reside with the petitioner and it is an unmatched marriage and for that he has filed a divorce petitioner but he is still ready to keep her. Heard learned APP also.

In this case, notice was issued to O.P.No. 2 and from office report, it appears that notice was validly served, however,

Patna High Court CR. MISC. No.4360 of 2019(4) dt.01-04-2019 2/2 no one appeared on behalf of the O.P.No. 2 on last date and today also nobody appears on behalf of her in such view of the matter, let petitioner surrender before the court below within a period of six weeks from the date of receipt of a copy of this order and on his surrender, court below shall release him on provisional bail for six months to its satisfaction. In the meantime, court will issue notice to the O.P.No. 2 and on her appearance, he will try to reconcile the matter and considering the conduct of the petitioner, will pass an appropriate order either confirming or rejecting the provisional bail granted to the petitioner.
