The petitioners are languishing in custody since 01.03.2015 and 11.02.2015 respectively in a case registered for the offences punishable under Sections 307, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the petitioners along with others came on the roof of their house and made
Patna High Court Cr.Misc. No.15561 of 2015 (02) dt.19-05-2015 2/2 indiscriminate firing leading to receiving injury by the informant, Awadh Kunwar, Suresh Kunwar, Ankit Kunwar and Vimal Kunwar.
It is submitted by learned counsel for the petitioners that the injuries have been found to be simple. The accusation has been levelled in the background of land dispute between the parties and there is counter version of the occurrence. Statement has been made in para 3 of both the petitions that the petitioners have no criminal antecedent and co-accused Manoj Singh and Anil Singh have been granted bail vide Cr. Misc. No. 37748 of 2014.
Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 116 of 2014.
