JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being husband of the deceased is languishing in jail custody since 24.03.2014 in a case registered under Sections 498A, 302, 201/34 of the Indian Penal Code. Admittedly, none has seen the actual killing of the deceased and the informant expressed his suspicion against the petitioner on the ground that prior to institution of this case the petitioner had executed a bond to keep the deceased with full honor and dignity but later on, the Skelton of the deceased was recovered from a river.
The contention on behalf of the petitioner is that the
Patna High Court Cr.Misc. No.26474 of 2014 (3) dt.13-01-2015 2/2 deceased was mentally derailed lady and as a matter of fact, she left her matrimonial home. Subsequently, a skeleton was recovered to which informant claimed to be of the deceased. He further submits that in course of investigation, some witnesses claimed to have seen the deceased going alone towards river. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Ghorasahan ( Jharokhar) P.S.Case No. 143 of 2011.
