JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be rice miller and the accusation against him is that he did not supply rice to the Corporation as per agreement executed between the parties and accordingly, he embezzled the government money to the tune of Rs. 66,42,540.80/- The contention on behalf of the petitioner is that even if the prosecution story assumed to be true, then also, it is a case of breach of contract and moreover, petitioner is ready to deposit 20% of the amount in question within six months in six instalments.
Patna High Court Cr.Misc. No.27271 of 2015 (2) dt.03-08-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 114 of 2015, subject to condition that he shall deposit 20 % of the amount in question within six months from the date of his release in six monthly instalments, failing which the learned court below shall be at liberty to cancel the bail bonds of the petitioner.
