JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-12-2021 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Yogapatti (Nawalpur) P.S. Case No. 323 of 2020 registered for offence punishable under sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

The allegation as per FIR is that the FIR named accused persons badly assaulted the informant and his younger brother, Basant Ram.

The learned counsel for the petitioners has submitted that there is case and counter case and petitioner no. 2, Suresh

Patna High Court CR. MISC. No.12002 of 2021(2) dt.24-12-2021 2/2 Ram has sustained grievous injury. He has also submitted that the allegation against the petitioner no. 1 is that he assaulted the informant and the petitioner nos. 2 and 3 assaulted Basant Ram, brother of the informant. The injuries sustained by the informant and his brother Basant Ram are simple in nature. Considering the fact that there is case and counter case and the injuries sustained by the informant and his brother Basant Ram are simple in nature, let the petitioners above named, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti (Nawalpur) P.S. Case No. 323 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
