The petitioners seek bail in connection with Gogri P. S. Case No 361 of 2019 instituted for the offence under Section 147, 148, 149, 307, 302, 504, 506 and 120B of the Indian Penal Code.

Petitioners and other accused persons are named in the F.I.R. and allegation against them is that they surrounded the informant and her husband and co-accused Kusho Yadav on the order of the petitioners fired on her husband causing his death.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.5500 of 2020(2) dt.03-02-2020 2/2 that they have falsely been implicated in this case and moreover, there is no allegation of firing against the petitioners rather the same is attributed to the co-accused of this case and as per F.I.R., the petitioners are only said to be the order giver and they have been in judicial custody for more than three months. Considering the submissions as above, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Gogri P. S. Case No 361 of 2019 .
