JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-09-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. The petitioner seeks bail in connection with Itarhi P.S. Case No.158 of 2020, registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code and section 27 of the Arms Act.
The prosecution case in short is that husband of the informant was driver of a Pick up van and went to Daltenganj from Varanasi and thereafter he was coming to Balia loaded with vegetable but he never reached Balia and his mobile was switched off. Information got information that dead body of her husband is found in the Pick-up van near Kukudha village.

No.11691 of 2021(3) dt.14-09-2021 2/2 It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. The petitioner is not named in the FIR rather his name transpired in this case on the basis of spy information on suspicion and the police after arrest took confessional statement forcibly. No incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner has no criminal antecedent and has been languishing in custody since 03.12.2020. Learned APP for the State opposed the prayer for bail. Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-IV, Buxar, in connection with Itarhi P.S. Case No.158 of 2020.
