Let the defect(s), if any, be removed within four weeks after complete start of the physical Court. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and Section 38 of the Weight and Measurement (Enforcement) Act, 1985.

Petitioner is a PDS Dealer. Allegation is by a consumer that petitioner was providing half kg. less grains of actual weight.

Considering the nature of allegation against the petitioner, in my view, this is not a fit case for grant of anticipatory bail in connection with Warisaliganj P.S. Case No. 83 of 2020, G.R. No. 917 of 2020 pending in the Court of learned Additional Chief Judicial Magistrate-II,

Patna High Court CR. MISC. No.15538 of 2021(2) dt.23-11-2021 2/2 Nawada/successor Court.

Hence, prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within a period of two weeks, prayer for regular bail shall be considered by the learned court below without being prejudiced by this order.
