The petitioner is in custody in connection with Excise Case No. 243 of 2019, for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent although there is no statement to the effect that he has got no criminal antecedent; and he is in custody since 15.10.2019. He further submits that in the instant case total 100 litres of country made liquor was seized.

Subject to the verification of the fact that if the petitioner has got no criminal antecedent, the court of 2nd
