JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. According to prosecution case, three culprits snatched cash and mobile from the informant and his friend on the point of pistol but out of the aforesaid three culprits, one was caught by the local people on the spot whereas rest managed to escape from there. The apprehended person was handed over to police and the said apprehended person disclosed his name as Ashish Kumar.

Contention on behalf of the petitioner is that petitioner was caught by the local people on mere suspicion and as a matter of fact, nothing was recovered from conscious possession

Patna High Court Cr.Misc. No.15974 of 2016 (2) dt.21-04-2016 2/2 of the petitioner and furthermore, petitioner does not have any criminal antecedent and is languishing in jail custody since 11.02.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, Patna in connection with Alamganj P.S.
