CORAM:
HONOURABLE MR.
JUSTICE CHAKRADHARI SHARAN SINGH
Patna High Court CWJC No.8621 of 2017 dt.24-01-2018 2/3 ORAL JUDGMENT & ORDER Date: 24-01-2018 Heard the parties.
2. The petitioner is aggrieved by the decision of the Central Board of Secondary Education (in short 'the CBSE'), as contained in letter, dated 31.05.2016, whereby, his application for correction in the date of birth has been rejected, on the ground of being time barred. It is the case of the petitioner that his date of birth is 31.12.1998, but in the certificate issued by the CBSE, the date of birth has been wrongly mentioned as 11.09.1998.
3. The petitioner passed the concerned All India Secondary School Examination in the year 2012. He applied for correction in his date of birth in the year 2016, which is the basis for rejection of his application, being time barred.
4. It is not in dispute that earlier one year limitation period was given for considering entries in the certificates. The said period has subsequently been extended to five years.
5. Considering the above, this application is disposed of with a direction to the Regional Officer, CBSE, Regional Office, Patna, to reconsider the petitioner's case for correction of his date of birth without taking any objection of delay in filing of the application. Such decision must be taken
Patna High Court CWJC No.8621 of 2017 dt.24-01-2018 3/3 by the CBSE within a period of two months from the date of receipt/production of a copy of this order.
6. The application stands disposed of accordingly. (Chakradhari Sharan Singh, J) Praveen-II/- AFR/NAFR NAFR CAV DATE N/A Uploading Date 25.01.2018 Transmission Date N/A
