The petitioner is languishing in custody since 27.10.2018 in a case registered for the offences punishable under Sections 272 and 273 of the IPC and Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is to the effect that from the possession of the petitioner, 6 litres and 300 Ml illicit foreign liquor were recovered.

It is submitted by learned counsel for the petitioner that investigation has already been concluded. A statement has been made in paragraph no.3 of the petition, though, the petitioner is involved in three other cases of similar nature, but in all the cases, he is on bail.

Patna High Court Cr.Misc. No.5485 of 2019(2) dt.31-01-2019 2/2 Learned APP submits that recovery has been made from the petitioner.

Considering the quantity of recovery, period under custody and the fact that investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Addl. Sessions Judge-II, Siwan in connection with Siwan Muffasil P.S. Case No. 603 of 2018.
