JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 The petitioner apprehends his arrest in connection with Sherghati (Dobhi) P.S.Case No. 85 of 2016 registered under Section 395 of the Indian penal Code.

Allegation as per FIR is that driver and Khalasi of the truck were ousted from the truck and snatched their mobiles and miscreants have taken away truck loaded with wheat. It further appears that petitioner is accused in one more case. Submission of learned counsel for the petitioner is that petitioner is not named in the FIR and only material that has come against him is confessional statement of co-accused. Heard learned APP also.

Having heard both sides and in view of allegation and criminal antecedent of the petitioner, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender

Patna High Court CR. MISC. No.7111 of 2019(3) dt.04-04-2019 2/2 within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
