The petitioner seeks regular bail in connection with Lalganj P.S. Case No. 371 of 2021 instituted for the offences under Sections 413, 414, 467, 468, 471 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 15.10.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that during the course of vehicle checking, the motorcycle of the petitioner was stopped by the police personnel and the paper was demanded by the police which was not shown by the petitioner and the said motorcycle was without any Registration number.
Patna High Court CR. MISC. No.4915 of 2022(2) dt.08-06-2022 2/2 Only by this allegation, it might be stolen motorcycle for use in the crime and it is further submitted that only on the basis of suspicion, petitioner was arrested.
Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 15.10.2021, charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Lalganj P.S. Case No. 371 of 2021 subject to the condition that petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.
