JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-04-2016 Heard learned counsel for the petitioner as well as learned counsel, appearing for the Vigilance. Petitioner seeks bail in a case registered under Sections-420, 467, 468 & 471, of the Indian Penal Code, Section65 of Information & Technology Act as also, under Sections-7, 8, 9 and 13(a) of Prevention of Corruption Act.

Petitioner was working as Assistant in the District Transport Office and co-accused, Rajesh Kumar, who was working as a private agent, was arrested by the police and on the basis of his confessional statement, several incriminating articles were recovered and a gang was boosted and it came to light that modus operandi of the aforesaid gang was to provide driving licence and other articles, after realizing heavy amounts from the

Patna High Court Cr.Misc. No.13837 of 2016 (2) dt.04-04-2016 2/2 people. It is alleged that the petitioner, being official of District Transport Office, was in hand & glove with the aforesaid persons including co-accused Rajesh Kumar.

Contention on behalf of the petitioner is that except socalled confessional statement of co-accused Rajesh Kumar, there is nothing on the record and moreover, co-accused, Rajesh Kumar, who was arrested by the police and in whose confessional statement, name of petitioner figured, has already been granted privilege lf bail by a coordinate bench of this court. Learned counsel, appearing for the Vigilance conceded this fact that except confessional statement of co-accused, Rajesh Kumar, there is nothing against the petitioner. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dumra P.S. Case No. 16 of 2014 (Special Case No. 04A/14) to the satisfaction of learned Special Judge, Vigilance, North Bihar, Muzaffarpur.
