JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 The petitioner seeks regular bail in connection with Masaurhi P.S. Case No. 545 of 2019, registered for offences punishable under Sections 420, 274, 275, 276 of the Indian Penal Code and Sections 27 (b)(ii), 28, 28(a) of Drugs and Cosmetics Act.
Allegation against the petitioner is of selling the medicine without valid license.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has been in judicial custody for four months and charge-sheet has been submitted and there is no chance of tampering with the evidence. Heard learned A.P.P. also.
Having heard both sides, considering the submission as above, let the petitioner above named, be released on bail on
Patna High Court CR. MISC. No.3644 of 2020(2) dt.21-01-2020 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Masaurhi, Patna, in connection with Masaurhi P.S. Case No. 545 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
