JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given axe blow on the neck of informant and in course of medical treatment, three incised wounds were found on the person of informant but opinion, regarding the aforesaid injuries, was kept reserved. The investigating officer has already submitted charge sheet without obtaining the complete injury report. Therefore, it is obvious that there is nothing on the record to show the nature of injury, sustained by the informant.
It is pertinent to mention here that this court could obtain the case diary and injury reports after great persuasion and therefore, it appears that the complete injury report has not

However, learned counsel appearing for petitioner drew my attention towards Annexure-4 to this petition and submitted that as a matter of fact, the informant took his treatment as outdoor patient and the aforesaid circumstance clearly goes to show that there was no serious injury on the person of the informant.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sasaram (Tilauthu) P.S. Case No. 282 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram.
