The petitioner seeks regular bail in connection with Forest Case No. 02 of 2016 registered for the offence punishable under Sections 2, 9, 27, 29, 31, 50, 51 and 52 of Wild Life Protection Act.
The allegation is regarding the informant having gone towards the forest upon hearing the gun shot firing where he saw the petitioner including one co-accused person as also a dead deer lying on the ground.
The learned counsel for the petitioner submits that there is no allegation of the petitioner having shot the deer and in fact there is no eye witness of the said occurrence, hence the
Patna High Court Cr.Misc. No.3102 of 2019(2) dt.23-01-2019 2/2 benefit can be granted to the petitioner while considering the present prayer for regular bail. It is submitted that prior to the lodging of the present case the petitioner was having a clean antecedent, however, another case arising out of the present case has been registered under the Arms Act in which the petitioner has already been granted bail. It is further submitted that the petitioner in custody since 20.08.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Forest Case No. 02 of 2016.
