In this case, the petitioner is seeking anticipatory bail in connection with Barahara (Krishnagarh O.P.) P.S. Case No.323 of 2019, registered for the offence under Section 304(B)/34 of the Indian Penal Code.
Allegation has been made that the accused persons including this petitioner have killed the victim by putting the electric shock to her.
Learned counsel for the petitioner submits that the petitioner is the mother-in-law of the deceased, who had informed the family of the deceased about the incident that the deceased sustained electric shock and being carried to hospital
Patna High Court CR. MISC. No.3012 of 2020(2) dt.28-02-2020 2/2 but, this petitioner has wrongly been framed in the present case. He further submits that the Inquest Report does not support the prosecution story.
Learned counsel for the informant has produced the photocopy of the postmortem report, wherein it has been recorded that 2-3 in no. bruises seen over both wrist. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
