The petitioner seeks bail in connection with Barbigha P.S. Case No. 606 of 2017 initially registered under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code and subsequently added with Section 302 of I.P.C. Petitioner is said to have called the informant and his father on the field and assault both of them by means of lathi, danda and rod in association of his sons. Subsequently his father succumbed to his injury.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. The

The allegation levelled against the petitioner is not specific rather general and omnibus. There is case and counter case between the parties. There was free fight between the parties and the person of the accused side has also sustained injury in the said occurrence. Regarding the said occurrence, co-accused Rahul Ranjan has lodged a case bearing Barbigha P.S. Case No. 605 of 2017. The petitioner has been languishing in custody since 19.11.2018. Co-accused, Dhananjay Singh @ Dhananjay Kumar @ Thothi and Rahul Ranjan @ Dipu have been enlarged on bail by different co-ordinate Benches of this Court vide order dated 23.05.2018 and 09.07.2018 passed in Cr. Misc. Nos.

22905 of 2018 and 35528 of 2018 respectively. On the other hand, learned counsel for the informant and learned APP for the State opposing the bail prayer of the petitioner submitted that the petitioner calling the deceased on the field eliminated him with the help of his sons. Hence, he does not deserve bail.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned
