JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections 328 and 304(B)/34 of the Indian Penal Code. Petitioner no.1 is father-in-law whereas petitioner no.2 is elder brother-in-law of the deceased and according to prosecution case itself, the marriage of deceased was solemnized in the year 2007 and she died in other than normal circumstance in the year 2015, i.e., after seven years of her marriage but even then the concerned Officer-in-Charge registered the case for the offence punishable under Section 304(B) of the Indian Penal Code and moreover, it is informed that after investigation, police submitted

Patna High Court Cr.Misc. No.16978 of 2016 (2) dt.28-04-2016 2/2 charge sheet under Section 302 and other minor Sections of the Indian Penal Code. There is omnibus allegation of illegal demand and administering poison to the deceased against the petitioners and others.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Samastipur in connection with Muffasil P.S. Case No.366 of 2015.
