JUSTICE SANJAY KUMAR ORAL ORDER 30-11-2017 Heard learned counsel for the appellants as well as the respondents.

The defendants of Title Suit No.50 of 1987 have filed this first appeal against the judgment and decree dated 31.05.1988 passed by Subordinate Judge-III, Vaishali at Hajipur whereby and whereunder the suit was decreed in favour of respondent no.1. The other respondents were proforma party. The appellants and the contesting respondents have compromised the case and they have filed a compromise petition praying therein to dispose of the appeal in terms of compromise.

The office has reported that the compromise petition has been duly signed by both the parties and their respective counsels. As such in view of the office report the compromise petition is accepted.

Patna High Court FA No.309 of 1988 (53) dt.30-11-2017 The judgment and decree of the court below is set aside and appeal is allowed in terms of compromise. The application being I.A. No.7535 of 2017 shall form part of the decree. This appeal is, however, dismissed against respondent nos.3 to 6. Accordingly, this appeal is disposed of.
