Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Konch P.S. Case No. 164 of 2022 lodged under Sections 341, 323, 494, 498(A), 504, 506 and 34 of the I.P.C. As per the prosecution case, the wife has filed this case against the husband (petitioner) and his family members. The allegation of second marriage is also there in the F.I.R. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that the petitioner's marriage was solemnized in the year 2003 and from her wife, he has 3 children. He was

Patna High Court CR. MISC. No.5037 of 2023(2) dt.04-03-2023 2/2 peacefully looking after the entire family but under suspicion only, the wife has filed this case alleging that he has second wife. Counsel further submits that the antecedent of the petitioner is clean and he is in custody since 15.07.2022. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st, Gaya in connection with Konch P.S. Case No. 164 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

The informant (wife) is at liberty to move for her grievances relating to maintenance before the appropriate forum.

With this observation, the bail application stands allowed.
