The petitioner is accused in connection with Mansi (Maheshkhut) Rail P.S. Case No. 21 of 2015, registered under Section 395, 397 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation the name of the petitioner came in the confessional statement of co-accused Santosh Yadav, except the confessional statement, there is nothing against the petitioner to show his involvement in the present case. Further submission is that, in fact, the petitioner is accused in three other cases, as detailed in para-03 of the

Patna High Court Cr.Misc. No.17693 of 2016 (2) dt.02-05-2016 2/2 petition, due to that reason the petitioner has also been implicated in this case. The petitioner is in custody since 08.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Rail Judicial Magistrate, Khagaria in connection with Mansi (Maheshkhut) Rail P.S. Case No. 21 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
