JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 The petitioner seeks regular bail in connection with Jogbani P.S. Case No. 310 of 2019, registered for offences punishable under Sections 30(a), 38(i) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 96 liters of liquor from the motorcycle of the petitioner and he was arrested on spot. It has been submitted on behalf of the petitioner that as a matter of fact nothing has been recovered either from the motorcycle or from the possession of the petitioner and he has no criminal antecedent and has been implicated in this case at the instance of the police and he has been in judicial custody since 21.10.2019 and charge-sheet has been submitted, as such, there is no chance of tampering with the evidence. Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge cum Special Judge, Araria, in connection with Jogbani P.S. Case No. 310 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
