The petitioner seeks bail in Shahpur P.S. Case No. 140/2014, registered for the offences punishable under Sections 341, 323, 354 and 504 of the Indian Penal Code. The father of the victim lodged the case stating that on 15.07.2014 his daughter had gone to collect wood. The petitioner assaulted the daughter of the informant and also committed rape with her. After three days of institution of the case the informant and his daughter made allegation that rape committed with the victim but the doctor did not find any sign of rape. One abrasion and pain and swelling on the right cheek were found on the person of the victim by the petitioner. The petitioner is in jail since 07.09.2014.

Considering the facts aforesaid, the petitioner above named

Patna High Court Cr.Misc. No.30355 of 2015 (2) dt.12-08-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge (Special Judge under POCSO Act), Patna, in connection with Shahpur P.S. Case No. 140/2014.
