JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-364/34 of the Indian Penal Code.

Petitioner is not named in the first information report but from perusal of the impugned order, it would appear that the victims of the present case were recovered from house of one Md. Kalam on the basis of confessional statement, made by coaccused, Pankaj Yadav. Two accused, namely, Umesh Ram and Pawan Mandal were arrested from the same house, where the victims had been confined. So far as petitioner is concerned; it would appear from the impugned order that name of the petitioner

Patna High Court Cr.Misc. No.16052 of 2016 (2) dt.21-04-2016 2/2 came in this case in confessional statement of co-accused and on the basis of aforesaid confessional statement, he was arrested on 18-04-2015 and since then, he is languishing in jail custody. There is nothing in the impugned order to show that the I.O. had taken any step to put the petitioner on test identification parade. Moreover, except the confessional statement as well as criminal antecedent of the petitioner, there appears to be nothing against him.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Halsi P.S. Case No. 55 of 2015 to the satisfaction of Sri Rajendra Das, learned Judicial Magistrate-Ist Class, Lakhisarai.
