The petitioner seeks bail in Turkauliya P.S. Case No. 827 of 2014, registered for the offences punishable under Sections 302, 328 and 34 of the Indian Penal Code.

The mother of the deceased alleged that she got information that his son was lying in a cremation ground. On such information, she along with others went there and her son disclosed that Indu Devi, Ashutosh Ram, Surendra Rai and Shivlochan Ram administered him poison. The son of the informant died on way to hospital.

It is submitted that similarly situated co-accused has already been enlarged on bail vide order dated 23.07.2015 passed in Cr.

Patna High Court Cr.Misc. No.28242 of 2015 (2) dt.04-08-2015 2/2 Misc. No. 25610 of 2015. The case of the petitioner stands on the same footing.

Considering the facts aforesaid and the fact that similarly situated co-accused has been granted bail, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 827 of 2014.
