JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 The petitioners apprehend their arrest in connection with Bathnaha P.S.Case No. 201 of 2018 registered under Sections 272 and 273/34 of the Indian penal Code and 30(a) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 495 litres of Nepali Shaufi liquor from a bamboo clamp of Ram Swaroop Mahto and it is said that same has been kept by the petitioners. Submission of learned counsel for the petitioners is that except information by spy, there is absolutely nothing material to show that seized articles are of the petitioners. Heard learned APP also.

Having heard both sides and in the facts and

No.4655 of 2019(4) dt.12-03-2019 2/2 circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ-IIcum-Special Judge, Excise Act, Sitamarhi in connection with Bathnaha P.S. Case No. 201 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
