In the background of prevailing land dispute with Diwakar Sahi, it has been alleged that a threatening was made to the informant on 09.10.2014, directing him to pay Rs.5,00,000/- to Mantu-Shambhu Group as well as to cause forceful possession over the land and in the background, it has been alleged that on 14.10.2014, two motorcycle borne criminals were loitering around his shop steering at him caused suspicion whereupon, police was informed and both of them were arrested and from their possession, the same SIM number were recovered through which he was threatened on 09.10.2014. It is also evident that from the written report that petitioner happens to be related with Diwakar Sahi and in the year 2010, he was instrumental in having the

Patna High Court Cr.Misc. No.17878 of 2015 (02) dt.20-05-2015 informant kidnapped for which Maniyari P. S. Case no.130 of 2010 was registered wherein he has been bailed out. Again, petitioner has been apprehended and presently, he happens to be under custody. Therefore, an allegation for hatching a conspiracy in order to put the informant under wrongful loss has been attributed.

Though, the petitioner has got chequered history, but taking into account the nature of allegation, petitioner, Kundan Kumar @ Kundan Kumar Thakur @ Kundan Thakur is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Anand Kumar Srivastava, Judicial Magistrate, 1st Class, Muzaffarpur in connection with Maniyari P. S. Case no.281 of 2014.
