JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 30.11.2015 on the accusation that he was caught red handed while he along with his associates was removing the electric coil from the transformer and on search, three pieces of electric coil and other instruments were recovered from possession of the petitioner.

Contention on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner and, as a matter of fact, petitioner was caught by the police on suspicion. Considering the period of detention of the petitioner in jail custody as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.16482 of 2016 (2) dt.26-04-2016 2/2 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Benipatti, Madhubani in connection with Madhwapur P.S.Case No. 60 of 2015/G.R. No.294 of 2015.
