Petitioner seeks bail in Nawkothi P.S. Case No.98 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that in the written report there is specific allegation against co-accused, Dhiraj Singh and Bittu Singh @ Baibhav Vardhan of causing fire arm injuries to brother of the informant on account of which he succumbed to the injuries in hospital. Petitioner is alleged to have taken the brother of the informant on car along with other co-accused, namely, Sintu Kumar, Navneet Kumar and Vikram Kumar.
Patna High Court Cr.Misc. No.3264 of 2019(3) dt.30-01-2019 2/2 Counsel for the petitioner further submits that coaccused, Vikram Kumar, has already been granted regular bail by co-ordinate Bench of this Court by order dated 24.01.2019 passed in Cr. Misc. No.2182 of 2019.
Petitioner is in custody since 05.10.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Nawkothi P.S. Case No.98 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
