JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 364A, 120B of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of the Arms Act. Petitioner and three others are said to have kidnapped the informant but they were caught with informant by the police and after that the present case was registered on the basis of statement of informant.

Submission on behalf of the petitioner is that petitioner is in jail custody since 05.07.2015 and having similar allegation, rest three accused have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated

Patna High Court Cr.Misc. No.19923 of 2016 (2) dt.06-05-2016 2/2 30.03.2016 passed in Cr. Misc. No. 11265 of 2016 as well as order dated 02.03.2016 passed in Cr. Misc. No. 5727 of 2016. It is further submitted that the present case is nothing but only a plantation of local police and as a matter of fact, when petitioner was made accused in the present case, he was remanded in another case i.e. Ahiyapur P.S. Case No. 583 of 2015 and except the present case as well as above stated case, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also with a view to maintain the parity of justice, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-X, Muzaffarpur in connection with Sessions Trial No. 33 of 2016 arising out of Ahiyapur P.S.
