JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends her arrest in a case registered for the offence punishable under Section 323, 341, 353 and some other minor Sections of the Indian Penal Code. As per the prosecution case, 10 FIR named accused persons and 15-20 unknown persons are alleged to have assaulted the police personnel with fists and slaps and tried to snatch their weapons.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has been implicated in the case only on suspicion. There is no specific allegation against this petitioner rather the allegations are general and omnibus. Petitioner is a house wife and she has got clean antecedent. Learned counsel appearing for the State opposes the

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of her arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Gaya in connection with Magadh University PS case No. 110/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
