JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bochahan P.S. Case No. 165 of 2013, registered under Section 364(A) and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner came in the confessional statement of co-accused Kailash Kumar showing the involvement of the petitioner in the present case, except the confessional statement, there is nothing against the petitioner. The petitioner is in custody since 06.02.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on

Patna High Court Cr.Misc. No.17864 of 2016 (2) dt.03-05-2016 2/2 bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-cum-Sub-Judge-XI, Muzaffarpur in connection with Bochahan P.S. Case No. 165 of 2013. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and further to furnish his correct address in case of change of address.
