The petitioner is languishing in custody since 30.03.2014 in a case registered for the offences punishable under Sections 20 and 22 NDPS Act.

From the wooden shop of Anil Yadav 1 1⁄2 kgs. Ganja like material, 150 pieces cigarettes filled up with Ganja and other equipments along with cash of Rs.1160/- were recovered. The petitioner started running away from the place of seizure, though the petitioner was apprehended on chase. It is submitted by learned counsel for the petitioner that the recovery is admittedly not made from the

Patna High Court Cr.Misc. No.24662 of 2014 (03) dt.08-01-2015 2/2 possession of the petitioner.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saharsa in connection with Special Case No. 04 of 2014 arising out of Saharsa (Sadar) P.S. Case No. 194 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
