JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 13.10.2014 in Madanpur P.S. Case No.173/13 (S.Tr.No.5/14) for the offence under Sections 395 and 397 of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in short, is that when the informant being Cash Officer in Madhya Bihar Gramin Bank, Branch Aurangabad, was going to distribute Rs.43,00,000/- on van and as soon as the said van stopped due to cattle on the road four miscreants on motor cycle surrounded the cash van and after indiscriminate firing causing fatal injuries to two guards looted firearms of Guards and Rs.43,00,000/- and fled away. On behalf of the petitioner it has been submitted that

Patna High Court Cr.Misc. No.26040 of 2015 (2) dt.29-07-2015 2/2 he is in custody since 13.10.2014 having no criminal antecedent. He is not named in the F.I.R. The only material is that he has been named by a co-accused. Some of the co-accused have been granted bail vide Cr.Misc. No.42453/14.

On behalf of the State it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge,Aurangabad, in Madanpur P.S.
