2. This application for grant of anticipatory bail arises out of Bidupur Police Station Case No. 631 of 2023, disclosing offence under Sections 341, 323, 504, 506, 354, 379, 307 and 34 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 24.10.2023, at about 08:00 A:M in the morning, when the informant was sitting at home, all the accused persons including the petitioner armed with lathi, rod, pistol etc. arrived at the door of the informant and demanded Rs. 50,000/- as ransom. When the informant refused, he started abusing and assaulting the informant and his family members. When the informant's father intervened, the petitioner assaulted him by iron rod on his face.

4. Learned Counsel for the petitioner submits that both the parties are co-sharers, having land dispute and the injury caused to the informant's father is simple in nature as it would be evident from the impugned order. Petitioner is having no criminal antecedent.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are co-sharers, having land dispute and the injury caused to the victim is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Vaishali at Hajipur, Bidupur Police Station Case No. 631 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
