The petitioner is apprehending his arrest in connection with Complaint Case No.885(C) of 2017 , registered for offences punishable under Sections 498(A) of the Indian Penal Code read with Section 4 D.P.Act.

As per the complaint case, there is allegation of demand of motorcycle and for non-fulfillment of demand, torture to the complainant and ousted her from the matrimonial home. Submission of the learned counsel for the petitioner is that allegations are false and concocted and he is still ready to keep her and he has also filed a petition for restitution of conjugal right before the Family Court, Buxar in January, 2019, which is numbed as Matrimonial Case no.5 of 2019. Heard learned A.P.P. also.

In this case notice was issued through registered cover

Patna High Court CR. MISC. No.4568 of 2019(6) dt.10-05-2019 2/2 to the O.P.No.2 and it appears from the service report that she has received ordinary notice as well as registered post but in spite of that nobody appears on behalf of the o.P.no.2 nor she appeared on 22.4.2019 and in the interest of justice, the case was put up today and today also nobody appears on behalf of O.P.no.2.

Having heard both sides, in such view of the matter, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Complaint Case No.885 (C ) of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
