The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 and other Sections of the Indian Penal Code.
The petitioner is not named in the FIR. One plastic bag was recovered from a drain containing the dead body. During the course of investigation, Savita Devi mother of the deceased disclosed that the deceased Raj Kumar Yadav had gone along with Kare Lal Yadav. Salaj Kumar, the brother of the deceased disclosed that he had seen the deceased Raj Kumar Yadav in the company of Sanjay Singh, Kare Lal Yadav, Dilip Sah, Pawan Yadav and Ankit Kumar Singh.
It is submitted that except suspicion that too after the
Patna High Court Cr.Misc. No.24753 of 2015 (2) dt.16-07-2015 2/2 recovery of the dead body, there is no other material. Similarly situated accused Sanjay Singh @ Sanjay Kumar Singh has already been enlarged on bail vide order passed in Cr. Misc. No. 19242 of 2015.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Bhagalpur in Bhagalpur G.R.P.S.
