The petitioner apprehends his arrest in connection with Complaint Case No. 270 of 2018 registered for the offence under Sections 323, 324, 341, 379, 498(A) and 504 of the Indian
Patna High Court CR. MISC. No.4245 of 2020(9) dt.25-10-2021 2/3 Penal Code and Sections 3/4 of the Dowry Prohibition Act. It is submitted by learned counsel for the petitioner that to show his bona fide and as a good gesture, petitioner offers to pay maintenance amount of Rs.3000/- (Rupees three thousand) per month to the opposite party no.2 starting from October, 2021.
Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipatti, District Madhubani in connection with Complaint Case No. 270 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
In the facts and circumstances of the case, the petitioner is ready to pay maintenance amount of Rs.3000/- by 7th day of every month and opposite party no. 2 shall furnish the bank account details to learned counsel for the petitioner in the court below so that the amount may be credited to the account of opposite party no. 2, subject to any order of maintenance passed by the competent court.
In case of default in payment of installment of
Patna High Court CR. MISC. No.4245 of 2020(9) dt.25-10-2021 3/3 maintenance, bail bond of the petitioner shall stand cancelled. With the aforesaid observations and directions, the anticipatory bail petition stands disposed of (Sandeep Kumar, J) BT/- U
