JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 19-07-2017 Grievance of the petitioner in this Public Interest Litigation is that an Anganwari Centre in Dhurgawn Gram Panchayat under Ekangar Sarai Block in Village- Chak Khirauti over Khata No. 154, Plot No. 226 was sanctioned, estimate was worked out and construction work had proceeded, construction was undertaken up to the plinth level spending more than 2,50,000/-. In the meanwhile, on account of the fact that NOC has not been obtained from the competent authority, the work was stopped. It is stated that now the NOC has been received and inspite of the same the construction is not
Patna High Court CWJC No.9027 of 2017 dt.19-07-2017 2/2 being proceeded. Indicating that inspite of representation submitted to the District Magistrate, Nalanda on 13.05.2017 nothing has been done for construction of the Anganwari Centre, petitioner has filed this writ petition in public interest.
Keeping in view the aforesaid grievance of the petitioner, for the present, without entering into the controversy on merit, Respondent No. 2, the District Magistrate, Nalanda is directed to take note of the representation of the petitioner, the facts as are detailed hereinabove and issue necessary direction in the matter of construction of the building in question in accordance to law within a period of one month from the date of receipt of certified copy of this order.
